Agreement to Terms

By accessing or using FollicleFX software and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the Services.

These Terms apply to all visitors, users, and others who access or use the Services. By using the Services, you represent that you are at least 18 years of age or have the consent of a parent or guardian.

License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the FollicleFX addon on devices you own or control
• Use the addon for personal or commercial projects
• Create derivative works (3D renders, animations, etc.) using the addon

License Restrictions

You agree NOT to:

• Redistribute, sell, lease, or sublicense the FollicleFX addon
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any proprietary notices or labels
• Use the software to develop competing products
• Share your license key with others outside your license scope
• Use automated systems to generate license keys
• Circumvent any license validation or copy protection measures

Intellectual Property

The FollicleFX addon, including its code, design, graphics, and documentation, is owned by FollicleFX and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain full ownership of any content you create using FollicleFX, including:

• Hair and fur grooming presets you create
• 3D renders and animations
• Commercial projects and productions

We do not claim any rights to your creative work produced using our software.

Payment & Billing

By purchasing a license, you agree to the following payment terms:

• All prices are listed in USD unless otherwise specified
• Payment is processed securely through our authorized payment provider
• Licenses are activated upon successful payment confirmation
• You are responsible for any applicable taxes in your jurisdiction

Subscription Licenses

If you purchase a subscription license:

• Billing occurs automatically at the beginning of each billing cycle
• You may cancel at any time before the next billing date
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused portions of a billing period

Updates & Support

Software Updates

Your license includes access to updates based on your license type:

• Founder License: Lifetime free updates
• Personal/Studio License: Free updates for one year from purchase date

Disclaimers & Limitations

As-Is Provision

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLLICLEFX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Cost of procurement of substitute goods or services
• Any damages arising from your use or inability to use the software

Our total liability shall not exceed the amount you paid for the license in the twelve (12) months preceding the claim.

Termination

We may terminate or suspend your license immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• License key misuse or unauthorized sharing
• Fraudulent payment or chargeback
• Violation of applicable laws

Upon termination, your right to use the software ceases immediately. You must destroy all copies of the software in your possession.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FollicleFX operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration, except where prohibited by law.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Services after any changes constitutes acceptance of the new Terms.
